Terms of Use

These terms explain what you can do with Art Blast and its Wallpapers, what we promise, and what we cannot promise.

1. Agreement

Art Blast is made and published by SAZ Games LLC, a Washington (USA) limited liability company ("SAZ Games", "we", "us", "our"). These Terms of Use cover the Art Blast app for iPhone and this website (together, "Art Blast").

By downloading, opening or using Art Blast, you agree to these terms and to our Privacy Policy, which explains what data the app handles. If you do not agree, please do not use Art Blast.

2. Who may use Art Blast

You must be at least 13 years old to use Art Blast. If you are under 18, you may use it only with the permission and involvement of a parent or legal guardian, who agrees to these terms on your behalf and is responsible for any purchases you make.

Art Blast is not directed at children under 13, and we do not knowingly collect personal data from children under 13.

3. Your licence to use the app and our Wallpapers

We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Art Blast app on Apple devices you own or control, as allowed by the App Store's usage rules, and to download and use our Wallpapers and Live Wallpapers as the Wallpaper or Lock Screen on your own phone or device.

That use is personal and non-commercial. Unless we agree otherwise in writing, you may not:

• sell, resell, license, rent or otherwise make money from our Wallpapers or Live Wallpapers, alone or as part of another product (for example prints, merchandise, stickers, phone cases, templates or Wallpaper packs);
• redistribute, share in bulk, or publish our Wallpapers as downloadable files on other apps, websites, stores or channels;
• re-upload our art or present it as your own work, or remove any marks or credits from it;
• scrape, crawl, mass download, or use bots or automated tools to copy the app's content or catalogue;
• mint our art as NFTs or other digital tokens;
• use our art, in whole or in part, to build, train, fine-tune or test machine learning or AI models, or include it in any dataset;
• copy, modify, decompile, reverse engineer or make derivative works of the app itself, except where the law expressly allows it.

Showing your own phone with an Art Blast Wallpaper on it, for example in a photo or video of your setup, is fine.

The licence is not a sale. We and our licensors keep all rights not expressly given to you here.

4. Wallpapers you make in the Editor

The Editor lets you make a Wallpaper from a photo you choose. Your photo is processed on your phone to make the Wallpaper and is not uploaded to us.

• What you make is yours. We claim no ownership of your photos or of the Wallpapers you make from them.
• You are responsible for your photo. Only use photos you took yourself or have the right to use. You are responsible for making sure your use does not infringe anyone else's rights, including copyright, privacy and publicity rights.
• Any Art Blast art, effects, frames or other elements the Editor adds remain covered by Section 3, so the personal, non-commercial limits there still apply to those parts.

5. Art Blast Pro

Art Blast Pro is a single, one-time in-app purchase. It is not a subscription and does not renew. The US price is $3.99; prices in other countries are set in local currency and may vary. The price shown in the app at the time you buy is the price that applies.

What Pro includes

• Ads removed.
• Every Live Wallpaper unlocked, including Live Wallpapers we add in the future.

There are no separate packs to buy.

Payment, refunds and restoring

• Apple handles payment, the receipt and refunds. We never see your card details.
• Refunds are decided by Apple under its policies. You can ask Apple for a refund at https://reportaproblem.apple.com.
• If you live in the EU or UK, Apple's terms also explain any right you have to cancel a digital purchase. Nothing here limits those rights.
• If you reinstall the app or move to a new iPhone, use Restore Purchases in the app (on the Help or Pro screen) while signed in with the same Apple Account you bought with.

Changes to the catalogue

We add, change and sometimes remove Wallpapers and Live Wallpapers over time. Pro gives you access to the Live Wallpapers available in the app while it is offered; it does not guarantee that any particular Wallpaper or Live Wallpaper will stay in the catalogue forever. Wallpapers you have already saved to your Photos stay on your phone.

6. Ads

Art Blast is free because of ads. Some downloads show a short rewarded video ad first, and you choose whether to watch it. There is a banner ad in some places. Ads are provided by Google AdMob. Current versions of the app request non-personalised ads only. Our Privacy Policy explains what AdMob may still collect.

We do not control or endorse what advertisers offer. Anything you do with an advertiser is between you and them. Art Blast Pro removes ads.

7. Acceptable use

When you use Art Blast, please do not:

• break, overload, or interfere with the app, its servers, or other people's use of it;
• try to get around Pro, ads, App Check, or any other security or access control;
• artificially inflate likes or download counts, or tamper with the app's data;
• access the app's backend or catalogue other than through the app as we provide it;
• use Art Blast for anything unlawful, or in a way that infringes anyone's rights;
• help or encourage anyone else to do any of the above.

8. Intellectual property and trademarks

The Art Blast app, its design, code and features, and the Wallpapers and Live Wallpapers in it, are owned by SAZ Games or its licensors and are protected by copyright, trademark and other laws. "Art Blast", "Art Blast Pro", "SAZ Games" and our logos are our trademarks. You may not use them in a way that suggests we endorse you or your product.

iPhone and Live Photos are trademarks of Apple Inc., registered in the U.S. and other countries. App Store is a service mark of Apple Inc. Other names and marks belong to their owners. Art Blast is not made by or affiliated with Apple.

9. Copyright complaints

We respect other people's rights. If you believe something in Art Blast infringes your copyright or other rights, email info@sazgames.com with:

• your name and how to reach you;
• a description of the work you believe is infringed;
• where it appears in Art Blast (the collection and Wallpaper name, or a screenshot);
• a statement that you believe in good faith the use is not authorised by you, your agent or the law;
• a statement that the information in your notice is accurate and that you are the owner, or are authorised to act for the owner;
• your physical or electronic signature.

We review every complaint and remove content where appropriate.

10. Third-party services

Art Blast relies on services from other companies, including Apple (the App Store and in-app purchases) and Google (Firebase and AdMob). Your use of those services is also subject to their own terms and policies, and we are not responsible for them. Links to other websites or apps, such as our pages on X and TikTok, are subject to those platforms' terms.

11. Disclaimers

We work hard to make Art Blast good, but we provide it "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not promise that Art Blast will always be available, error free, or work on every device or iOS version. Live Wallpapers depend on iOS: they need iOS 17 or later, they stop moving in Low Power Mode, and some iPhones or clips may not allow motion. These are limits of iOS, not something we control.

Some places do not allow certain warranties to be excluded, so some of the above may not apply to you. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

12. Limitation of liability

To the fullest extent the law allows, SAZ Games and its members, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of, or inability to use, Art Blast, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for any claim related to Art Blast is limited to the greater of the amount you paid for Art Blast Pro in the 12 months before the claim, or US $50.

These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

13. Termination

You can stop using Art Blast at any time by deleting the app. Deleting the app removes the settings, likes and other data stored on your phone.

If you break these terms, your licence ends automatically, and we may take reasonable steps to stop your device using Art Blast. We may also change, suspend or discontinue Art Blast, or any part of it, at any time. Sections 3 (the limits on use), 8, 11, 12, 14, 15 and 16 continue to apply after your licence ends.

14. Apple App Store terms

If you got Art Blast from the Apple App Store, the following also applies, and it takes priority over anything else in these terms where they conflict:

1. Agreement is with us. These terms are between you and SAZ Games only, not Apple. SAZ Games, not Apple, is solely responsible for Art Blast and its content.
2. Scope of licence. Your licence is limited to using Art Blast on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts associated with you through Family Sharing or volume purchasing where available.
3. Maintenance and support. SAZ Games is solely responsible for any maintenance and support of Art Blast. Apple has no obligation to provide any maintenance or support for it.
4. Warranty. SAZ Games is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Art Blast fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of Art Blast to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Art Blast.
5. Product claims. SAZ Games, not Apple, is responsible for addressing any claims from you or any third party relating to Art Blast or your possession or use of it, including product liability claims, claims that it fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
6. Intellectual property claims. If a third party claims that Art Blast or your possession and use of it infringes their intellectual property rights, SAZ Games, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
7. Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer contact. Questions, complaints or claims about Art Blast should be sent to SAZ Games LLC at info@sazgames.com.
9. Third-party terms. You must comply with any applicable third-party terms when using Art Blast, such as your wireless data service agreement.
10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple will have the right, and will be deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary.

15. Governing law

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law rules. Any dispute that cannot be resolved informally will be handled by the state or federal courts located in Washington State, and you and we agree to their jurisdiction. If you live in a country whose laws give you the right to bring claims in your local courts, or give you protections that cannot be waived, nothing here takes those rights away.

16. General

If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms; we may transfer ours, for example if Art Blast changes owner. These terms, together with our Privacy Policy, are the whole agreement between you and us about Art Blast.

17. Changes to these terms

We may update these terms from time to time, for example when the app changes or the law requires it. When we do, we will post the new version on this page and change the effective date above. If a change is significant, we will make reasonable efforts to let you know, for example in the app. If you keep using Art Blast after a change takes effect, you accept the updated terms.
